Terms of Service

Welcome to Gladius Proba. These Terms of Service ("Terms") govern your use of the Gladius mobile application and related services (the "Service"), operated by Gladius Proba ("Gladius", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EU/UK) to create an account. By using Gladius you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. Your account

• You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
• You agree to provide accurate information and to keep your profile current.
• You may not share, sell, or transfer your account, Friend Code, or Denarii balance to anyone else.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraud, cheating or abuse.

3. Health & physical activity

• The Service is for general fitness and entertainment purposes only and is not medical advice.
• You are responsible for ensuring your environment is safe before performing any exercise (clear floor space, good footing, adequate lighting).
• Pose detection counts repetitions but cannot evaluate your underlying health, cardiovascular condition, or risk of injury.

4. Fair play & conduct

The competitive integrity of Gladius depends on every player giving an honest effort. You agree not to:

• Manipulate, spoof or otherwise circumvent the pose-detection rep counter (e.g. using video playback, props, or another person performing reps for you).
• Use unauthorised software, bots, scripts or modified clients.
• Exploit bugs in the matchmaking, MMR, Denarii or Legion systems.
• Harass, threaten, dox or otherwise mistreat other users in display names, messages, or Legion communications.
• Impersonate another person or misrepresent your affiliation.
• Use the Service for anything unlawful, or in any way that violates the rights of others.

We may, at our discretion, reset stats, revoke Denarii, demote ranks, or terminate accounts that breach these rules.

5. Denarii & the in-game economy

• Denarii are an in-game currency only. They have no monetary value, are not redeemable for cash, and cannot be transferred outside the Service.
• Denarii are licensed to you for personal use within the Service. You do not own them.
• We may, in our sole discretion, adjust Denarii balances, reward rates, costs and recovery mechanics, including in response to abuse or to maintain game balance.
• Unused Denarii are forfeited if your account is terminated.

6. User content

You retain ownership of any content you submit (display name, Legion name, profile information). By submitting it, you grant Gladius a worldwide, royalty-free licence to host, display and use it for the purpose of operating the Service. You represent that you have the right to grant this licence and that your content does not infringe any third-party rights.

7. Intellectual property

The Service — including the Gladius name, logo, visual design, ranks, Roman-themed terminology and all associated software — is owned by Gladius and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. All other rights are reserved.

8. Third-party services

Gladius relies on third-party services including Clerk for authentication and Google ML Kit for on-device pose detection. Your use of those features may also be subject to the relevant third party's terms.

9. Termination

• You may delete your account at any time from Card > Settings, or by contacting us.
• We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if we discontinue the Service.
• Sections 5 (Denarii), 6 (User content), 7 (IP), 10 (Disclaimers), 11 (Liability) and 13 (Governing law) survive termination.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that pose detection will be perfectly accurate. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Gladius and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from or related to your use of the Service. Our aggregate liability for any claim arising from these Terms or your use of the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.

12. Changes to the Service or these Terms

We may modify, suspend or discontinue any part of the Service at any time. We may also update these Terms; if changes are material, we will notify you in-app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles. The courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms or the Service, except that you may bring a claim in your country of residence where required by mandatory consumer-protection law.
